Aging Well Denver LLC (“Aging Well”) is committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the Personal Data (as defined below) we collect from users of our website (“Visitors”) located at [INSERT HYPERLINK] (“Site”), and Visitors who create an Account with us to access certain of our Services (“Members”). Capitalized terms not defined in this Privacy Policy shall have the meanings given to them in our Terms and Conditions, located at [INSERT HYPERLINK].

User Consent.  By submitting Personal Data through our Site, you agree to the terms of this Privacy Policy, and you expressly consent to the collection, use and disclosure of your Personal Data in accordance with this Privacy Policy.

Data Collection.  As you use the Site, we collect information about you and the services you use. The Personal Data and Anonymous Data we collect falls into two different categories: (1) information you give us; and (2) information we collect from you automatically. “Personal Data” means data that allows someone to identify you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. “Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons.

  1. Information You Provide to Us.

    • If you create an Account with us, we may collect Personal Data from you such as your email.

    • If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to respond to you or otherwise address your feedback or message.

    • We also collect other types of Personal Data that you provide to us voluntarily, such as certain requested information if you contact us via e-mail regarding support for the Services.

    • Please note that you can choose not to provide us with certain information, but this may limit the features of the Site or Services you are able to use.

    • Please do not send us sensitive information such as medical or financial information.  Also, please note that any information you post in any public forum can be seen, disclosed to or collected by third parties and may be used by others in ways we cannot control or predict.

  2. We do not require Visitors to submit Personal Data to us while visiting the Site; however, we do require Visitors to submit Personal Data to use our interactive tools and to register for specific newsletters.

  1. Information Collected Automatically.

    • The information we may collect by automated means includes, but is not limited to, information on actions taken on the Site (such as page views and site navigation patterns).

    • We may also use cookies and URL information to gather data regarding the information for which you searched and that you viewed. A “Cookie” is a text file that websites send to a Visitor’s computer or other Internet-connected device to uniquely identify the Visitor’s browser or to store information or settings in the browser. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Persistent Cookies can be removed by following Internet browser help file directions.

    • We may also use third party tracking services to track and analyze Anonymous Data from users of our Site.

    • Sponsors or advertisers on the Site may serve content and advertisements directly to you, and they may use their own cookies, web beacons or other online tracking technologies in the advertisements or sponsored links on the Site to collect Anonymous Data from you. While we generally permit the use of these third party cookies and web beacons, we do not control how third parties use cookies or web beacons or how they manage the Anonymous Data they gather through the use of these technologies on the Site.

Disclosure of Your Personal Data. We may disclose your Personal Data as described below and as described elsewhere in this Privacy Policy; all other uses and disclosures not described in this Privacy Policy will be made only with your written authorization.

  1. Third Party Service Providers. We may share your Personal Data with third party service providers to: provide us with certain products or services; provide you with the Services that we offer you; market certain products to you that may be relevant for your business, conduct quality assurance testing; facilitate creation of accounts; provide technical support; and send you newsletters. It is our practice to require these third party service providers to not use your Personal Data other than to provide the services requested by Aging Well.

  2. Other Third Parties. We do not sell, rent, individually post, or otherwise disclose any personal information about Visitors to unrelated third parties for marketing purposes.

  3. Transfer of Assets. We reserve the right to transfer your Personal Data to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets. Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use your Personal Data in a manner that is consistent with this privacy policy.

  4. Other Disclosures. Regardless of any choices you make regarding your Personal Data (as described below), Aging Well may disclose Personal Data if it believes in good faith that such disclosure is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on Aging Well; (c) to protect or defend the rights or property of Aging Well or users of the Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy or the Terms and Conditions.

Third Party Data Collection.

  • Newsletters. Aging Well may employ or use the services of third parties for the development and/or the distribution of newsletters by Aging Well or other third parties to you. We may collect Personal Data from you in order to maintain these newsletters; however, it is our practice to require these third parties to agree not to sell or rent the email addresses of any newsletter subscriber to any other third party.

  • Information Collected by Other Third Parties. This Privacy Policy addresses only our use and disclosure of information we collect from and/or about you. If you disclose information to others, the use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. In addition, information made available through the Services may be protected by applicable privacy laws.

Third Party Websites. The Site may contain links to other websites that are not owned or controlled by us. We have no control over, do not review, and are not responsible for the privacy policies and content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site. During this process, another entity may collect Personal Data or Anonymous Data from you. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.

Your Choices Regarding Your Personal Data.  We offer you choices regarding the collection, use, and sharing of your Personal Data.

  1. We may periodically send you free newsletters and e-mails that directly promote the use of our Site or the Services we offer. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by contacting us at info@agingwelldenver.com.  If you receive newsletters or promotional communications from another third party, you must contact that entity to determine how you can “opt-out.”

  2. Despite your indicated e-mail preferences, we may send you Service related communication, including notices of any updates to our Terms and Conditions or Privacy Policy.

  3. You may change or modify any information you previously provided to us by contacting us at info@agingwelldenver.com.  However, when we delete any information, it will be deleted from the active database, but may remain in our archives. We may retain your information as required by law and to investigate or assist in preventing any fraud or similar purposes. Please remember, however, if we have already disclosed some of your Personal Data to third parties, we cannot access that Personal Data any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.

Security of Your Personal Data. Aging Well is committed to protecting the security of your Personal Data. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while Aging Well uses reasonable efforts to protect your Personal Data, Aging Well cannot guarantee its absolute security.
